1. Introduction

These Terms of Service (“Terms”) govern the use of the sPoint Help Desk service (the “Service”), operated by sPoint (“Company”, “we”, “our”, or “us”).

By using the Service, you agree to comply with these Terms. If you do not agree with these Terms, you must not use the Service.
2. Description of the Service

The Service provides automated business communication tools, including the ability to send and receive messages via WhatsApp Cloud API for operational purposes such as customer support notifications, service updates, and system-triggered messages.

The Service is intended strictly for business communication and operates through server-side integration with WhatsApp Cloud API.
3. Eligibility

You must be legally permitted to use the Service under applicable laws.
By using the Service, you confirm that you have the authority to act on behalf of a business or organization when applicable.
4. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms and all applicable laws and regulations.

The following activities are strictly prohibited:
  • sending spam or unsolicited messages
  • sending bulk or mass messages without user consent
  • using the Service for advertising or marketing campaigns without explicit user permission
  • misuse or abuse of WhatsApp services
  • attempting to bypass WhatsApp or Meta policies
Any violation of these rules may result in suspension or termination of access to the Service.
5. WhatsApp Usage and Compliance

The Service uses WhatsApp Cloud API in compliance with WhatsApp and Meta policies.

Important conditions:
  • Messages are sent only via server-side API integration
  • The Service does not provide access to WhatsApp Business management features for end users
  • The Service does not support bulk messaging, spam, or unsolicited communication
  • All usage of WhatsApp through the Service must comply with WhatsApp Business and Meta Platform Policies
6. User Responsibilities

Users are responsible for:
  • ensuring that recipients have provided appropriate consent where required
  • complying with all applicable laws and regulations
  • using the Service responsibly and ethically
Users must not use the Service in any manner that could harm WhatsApp, Meta, or other users.
7. Data Protection and Privacy

The Service processes data in accordance with applicable data protection laws.
We do not sell, rent, or share personal data with third parties for advertising or profiling purposes.
